ARCHIVED - 10,000-euro fines for possessing cannabis in Yecla overturned by Murcia courts
Judges rule that Yecla Town Hall was not empowered to impose such strict punishments last year
The Town Hall of Yecla made the headlines last summer by dint of its attempt to clamp down on the use and ownership of cannabis, imposing fines of more than 10,000 euros people found to have the substance in their possession and making clear the intention to continue adopting this hard-line policy, but this week the courts of Murcia have annulled the fine and opened the door to cancelling hundreds of similar punishments.
The magistrate at the “Juzgado Contencioso-Administrativo” nº5 in Murcia has ruled that the Town Hall of Yecla was not empowered to punish a repeat offender found to be in possession of cannabis last September with a fine of 10,041 euros, the implication being that 60 other similar punishments are also invalidated. Instead, according to the Brotsanbert law firm which brought the cases to the attention of the Spanish media, fines of 100 euros could be applied.
One of the most often quoted cases last year involved a re-offender who hurried to pay his fine quickly and was rewarded with a 50 per cent reduction, but still ended up paying 5,200 euros after being found to own a marijuana shredder which contained precisely 0.01 grams of cannabis.
But while the police in Yecla maintained that they were simply applying the letter of the law, the appeal lodged by Brotsanbert alleged that in order for the Town Hall to impose such large fines the regional government would have had to delegate its own authority to do so, and this had not occurred. The judge agreed, and as a result the fine is null and void.
